Terms of Use

These Terms of Use govern your access to and use of The Pedagogy Community® platform, including its website, applications, content, services, and public forums.

By accessing or using the Platform, you agree to be bound by these Terms, along with our Privacy Policy, Refund Policy, and any other applicable policies published from time to time.

By using this Platform, you acknowledge that you have read, understood, and agreed to these Terms of Use.

If you do not agree with any part of these Terms, please do not use the Platform.

These Terms of Use set out the terms and conditions for use of The Pedagogy Community® website ("Website") and any content, public forums, or services offered on or through the Website and/or through any mobile application(s) ("Application") (collectively referred to as the "Platform").

These Terms of Use apply to end users of the Website (referred to as "Learners", "You", "Your"). These Terms of Use, including the Privacy Policy, Refund Policy, and any other terms and conditions published on the Platform or communicated to you from time to time (collectively referred to as the "Agreement"), define the relationship and responsibilities between You and the Company in using the Platform.

When we speak of "Company", "we", "us", and "our", we mean The Pedagogy Community®, the entity that owns, manages, and/or operates this Platform.

"Creator" shall mean the Company and/or any authorised instructors, educators, or content providers who make content available on the Platform.

By accessing this Platform, you agree to be bound by the terms of this Agreement, all applicable laws and regulations, and any updates made from time to time.

If you disagree with any part of this Agreement or do not wish to be bound by it, please do not use the Platform in any manner.

  1. Access and Registration

    If you are an individual, you must be at least 18 (eighteen) years of age. If you are between the ages of 13 and 18, you must have the permission of your parent or legal guardian to use the Platform. By using the Platform, you represent and warrant that you have obtained the appropriate consent or permission to do so. If you are under the age of 13 years or 16 years (depending on your country of residence), you may neither use our Platform in any manner nor register for any content or services offered therein.

    To access any "Content" offered on the Platform, we may require you to register by providing your name and email address. Please read our Privacy Policy to understand how we handle your information. You may also be required to pay a fee to access certain Content, where applicable. For more information, please refer to the Payments and Refunds section below.

    You represent that the information provided by you during your enrolment or registration is true and complete, that you meet the eligibility requirements for use of the Platform and the Content offered therein, and that you will update us in the event of any changes by writing to us using the contact details provided below.

    For the purpose of this Agreement, "Content" means and includes any course or session (whether pre-recorded or live) published by the Creator on the Platform, including but not limited to any reference materials and text files offered to you as part of the Content.

    When you register or enrol for any Content on the Platform, you may also have access to discussion forums that enable you to exchange your thoughts and knowledge in relation to the Content or its subject matter with us and other registrants to the Content ("Public Forum"). Participation in the Public Forum is completely optional.

    We reserve the right to refuse access to the Platform or remove content posted by you in the Public Forums at any time without notice if, in our opinion, you have violated any provision of this Agreement.

    To access the Platform and/or view the content on the Platform, you will need to use a "Supported/Compatible Device", meaning a personal computer, mobile phone, portable media player, or another electronic device that meets the compatibility requirements and on which you are authorized to operate the Platform. Compatibility requirements may change from time to time.

  2. Termination

    The Company reserves the right to suspend or terminate a user’s access to the Platform, at its sole discretion, without prior notice, in the event of any violation of these Terms or applicable law.

    Upon termination, all rights granted to the user under these Terms shall immediately cease.

    No refunds shall be provided except in accordance with the Refund Policy.

  3. License to Use

    You are granted a limited, non-exclusive license to access and view the Content on the Platform for your own personal, non-commercial use only. If permitted on the Platform, you may temporarily download one copy of any downloadable Content, including Creator Content, for personal and non-commercial transitory viewing only.

    This license does not grant you the right to assign or sublicense the license granted under this Agreement to anyone else. Further, you may not:

    1. Modify, edit, or copy the Content, Creator Content, or any material made available on the Platform.
    2. Create derivative works or exploit any material made available on the Platform in any way not permitted under this license.
    3. Publicly display the Content, Creator Content, or any material made available on the Platform, whether commercially or non-commercially, or use the same for any commercial purpose.
    4. Attempt to decompile or reverse engineer any software contained in the Platform.
    5. Remove any copyright or other proprietary notices from the Content, Creator Content, or any material made available on the Platform.
    6. Transfer any material made available on the Platform to another person or mirror the same on any other server.

    For the purpose of this Agreement, "Creator Content" means and includes any audio files, video files, audio-visual files, images, text materials, and documents (including .doc, .docx, and .pdf files), other than the Content, uploaded or published on the Platform by the Creator to be accessed by you.

    This license shall automatically terminate if you violate any of these restrictions and may also be terminated by us at any time. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

  4. Communications

    The Platform includes Public Forums designed to enable you to communicate with us and with other registrants of the Content you have enrolled in. Use of these forums is entirely your choice. However, if you choose to participate, you agree to adhere to the terms specified in the Code of Conduct section below and any other terms published on the Platform.

    If it comes to our notice that your conduct violates the terms of this Agreement, we may terminate or suspend your access to any Public Forum at any time, without notice, for any reason.

    You represent and warrant that you own and control all rights in and to any content uploaded or posted by you on the Public Forums or anywhere else on the Platform ("Learner Content"), or that you are otherwise licensed to use and reproduce such Learner Content.

    We are not responsible for the information you choose to share on Public Forums, or for the actions of other users therein. You understand and agree that you shall be solely responsible for your Learner Content, including its legality, reliability, accuracy, appropriateness, and the consequences of its publication.

    Unless otherwise indicated by you in writing, you hereby grant us a non-exclusive, royalty-free, irrevocable, perpetual, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Learner Content throughout the world in any media.

  5. Code of Conduct

    You agree to the following:

    1. Legitimate usage of the Platform: You agree to use the Platform only for lawful purposes and not to engage in any activity that violates any applicable law or regulation. You must not use the Platform in any manner that disrupts, damages, or impairs the Platform or access to it.
    2. No harmful or dangerous content: Any content which incites or promotes violence, may cause physical or emotional harm, or may endanger the safety of any individual is expressly prohibited on the Platform.
    3. No hateful or defamatory content: We do not tolerate any form of hate speech, defamatory content, or statements that are abusive, threatening, violent, or discriminatory in nature.
    4. Violent and graphic content: Content intended solely to sensationalize, shock, or disturb individuals is not allowed. Content promoting terrorist acts or inciting violence is also prohibited.
    5. Harassment and bullying: We do not tolerate harassment or bullying on the Platform. This includes abusive messages, revealing someone’s personal information, humiliating content, sexual harassment, and sexual bullying in any form.
    6. Spam: Posting untargeted, unwanted, and repetitive content, comments, or messages with the intention of spamming or driving traffic to third-party sites is prohibited.
    7. Scams: Any content uploaded or posted in order to deceive others for financial gain is strictly prohibited.
    8. Privacy violations: Kindly refer to our Privacy Policy to understand how to protect your privacy and respect the privacy of others.
    9. Impersonation: Impersonating another person, learner, institution, company, or group is not permitted.
    10. Unauthorized access or disabling of the Platform: You agree not to use the Platform in any way that could disable, overburden, damage, or impair it, nor attempt to gain unauthorized access or introduce harmful code such as viruses, malware, worms, or trojan horses.
    11. If any violation of the above rules comes to our notice, we reserve the right to refuse your access to the Platform, terminate accounts, or remove such content at any time without notice.
  6. Indemnification

    The user agrees to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:

    1. the user’s use or misuse of the Platform;
    2. any violation of these Terms; or
    3. any infringement of intellectual property or other rights of any third party.
  7. Intellectual Property

    We own all information and materials, including Content and Creator Content, provided or communicated to you by or on behalf of us, including but not limited to the Platform, trademarks, logos, illustrations, designs, layouts, graphics, audio files, video files, software, instructions embedded in digital documents, and all other related materials ("Creator’s Intellectual Property").

    You acknowledge and agree that you do not acquire any ownership rights in Creator’s Intellectual Property through your use of the Platform. Any unauthorized use, reproduction, modification, distribution, or display of Creator’s Intellectual Property is strictly prohibited.

  8. Feedback

    If you submit suggestions, ideas, comments, questions, or other product feedback about any Content, the Platform, or any part thereof ("Feedback"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form.

  9. Payments and Refunds

    To register or enrol for any Content, you may need to pay a fee as applicable ("Content Fee"). Please refer to our Platform for pricing details. Payment of such fees may be processed through third-party payment processors.

    Once you purchase access to Content on the Platform, the same cannot be cancelled and there shall generally be no refund of the Content Fee, unless otherwise stated in our Refund Policy.

    We do not capture or store any sensitive personal information related to your payment methods. While making payments through third-party payment gateways, please ensure that you read their terms and policies carefully.

  10. Disclaimer of Warranties

    The Platform and all content, services, and materials made available through it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

    The Company does not warrant that the Platform will be uninterrupted, error-free, or secure, nor does it make any representation regarding the accuracy, completeness, or reliability of any content.

    The Company further disclaims any guarantee that use of the Platform will result in any specific academic, professional, or commercial outcome.

    To the maximum extent permitted under applicable law, the Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

  11. Limitation of Liability

    To the maximum extent permitted under applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with the use of, or inability to use, the Platform.

    In no event shall the total liability of the Company, whether arising in contract, tort, or otherwise, exceed the amount actually paid by the user for the relevant services.

    Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you to the extent prohibited by applicable law.

  12. Links to Third-Party Websites

    The Company has not reviewed all of the sites linked to its Platform and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the Company of such site. Use of any linked website is at your own risk.

  13. Miscellaneous

    1. Alteration of Platform or amendments to the conditions: We reserve the right to make changes to our Platform, policies, and this Agreement at any time. You should review the Platform regularly to stay informed of any updates.
    2. Waiver: If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
    3. Assignment: You may not assign or transfer this Agreement, whether by operation of law or otherwise. Any attempt to do so shall be null and void.
    4. Severability: If any provision of this Agreement is adjudged to be unenforceable or invalid, that provision shall be limited to the minimum extent necessary so that the remainder of the Agreement remains in effect.

  15. Force Majeure

    The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay is due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, internet or technical failures, governmental actions, or public health emergencies.

  16. Dispute Resolution

    Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.

    The arbitration shall be conducted by a sole arbitrator appointed by the Company.

    The seat and venue of arbitration shall be Lucknow, Uttar Pradesh.

    The language of the arbitration proceedings shall be English.

    The arbitral award shall be final and binding on the parties.

  17. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of India.

    Subject to the arbitration clause above, the courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction over all matters arising out of or relating to these Terms.
