This Privacy Policy explains how The Pedagogy Community® collects, uses, stores, protects, and discloses information of users on training.thepedagogycommunity.org.

By accessing and using the Platform, you consent to the collection, use, and disclosure of information described in this Policy and our Terms of Use.

This Privacy Policy (the "Policy") governs the manner in which The Pedagogy Community® or "We" on training.thepedagogycommunity.org (the "Platform") collects, uses, maintains, and discloses information of its users.

This Policy also describes the practices that we apply to such user information, your privacy rights, and your choices regarding your information. This Policy applies to all users of the Platform (referred to as "Learners", "You", "Your").

By accessing and using the Platform, providing your Personal Information, or otherwise signaling your agreement when the option is presented to you, you consent to the collection, use, and disclosure of information described in this Policy and our Terms of Use, and we disclaim all liabilities arising therefrom.

Capitalized terms used but not defined in this Privacy Policy shall have the meanings assigned to them in our Terms of Use.

Personal Information

"Personal Information" means information that identifies a Learner, such as first and last name, identification number, email address, age, date of birth, gender, location, photograph, and/or phone number provided at the time of registration or any time thereafter on the Platform.

"Sensitive Personal Information" includes: (i) passwords and financial data (except the truncated last four digits of a credit/debit card), (ii) health data, (iii) official identifiers, proof of identity or proof of address documents (such as biometric data, Aadhaar number, social security number, driver’s license, passport, etc.), (iv) information about sexual life, sexual orientation, race, ethnicity, political or religious beliefs or affiliations, (v) account details, passwords, PAN, or (vi) any other data categorized as sensitive personal data or special categories of data under applicable Data Protection Laws.

References to "Personal Information" in this Policy shall include "Sensitive Personal Information" where applicable in the context of use.

Information We Collect

We may collect both personal and non-personal identifiable information from you in a variety of ways, including when you visit our Platform, register on the Platform, and use activities, services, features, or resources made available through it.

  1. We do not ask you for Personal Information unless we truly need it, such as when you register for any Content on the Platform.
  2. We do not share your Personal Information except where necessary to comply with applicable law, develop our products and services, or protect our rights.
  3. We do not store Personal Information on our servers unless required for the ongoing operation of our Platform.

When you interact with our Platform, we may collect non-personal-identifiable information such as browser name, language preference, referring site, the date and time of each user request, operating system, Internet service provider details, and similar technical information.

In the event of an app error, we may collect technical Log Data through third-party tools. This may include your device’s IP address, device name, operating system version, app configuration, time and date of your use of the Service, and other statistics.

Cookies

To enhance user experience, our Platform may use cookies. A cookie is a string of information that a website stores on a visitor’s computer and that the visitor’s browser provides back to the website each time the visitor returns.

This Service does not explicitly use cookies directly in all cases. However, the app may use third-party code and libraries that use cookies to collect information and improve their services. Please note that some parts of the Platform may not function properly if cookies are refused or disabled.

To provide access to our Platform and/or the services/products offered therein

We use your information to allow you to access the Platform and the services/products offered on it, including customer service, fulfilling purchases, verifying user information, and resolving any glitches with the Platform. The legal basis for this processing is consent, our legitimate interests in the proper administration of our Platform, and/or the performance of a contract between you and us.

To conduct KYC verification

We may use your information where applicable laws or regulations require KYC verification of Learners. The legal basis for this processing is consent, our legitimate interests, and/or the performance of a contract where applicable.

To improve our Platform and maintain safety

We use your information to improve and customize the Platform and its services/products. We also use it to prevent, detect, investigate, and take measures against criminal activity, fraud, misuse of or damage to our Platform or network, and violations affecting our rights, property, users, or others.

To communicate with you or market our services/products

We may use your email address to communicate with you regarding your orders, offers, new products, services, and to receive your feedback. It may also be used to respond to your inquiries, questions, and requests. If at any time you would like to unsubscribe from receiving future emails, you may write to us using the contact information provided below.

Service Providers

We may employ third-party companies and individuals for the following purposes:

  1. To facilitate our Service;
  2. To provide the Service on our behalf;
  3. To perform Service-related services; or
  4. To assist us in analyzing how our Service is used.

You always have the option to choose the information you provide to us, including updating or deleting your information. However, lack of certain information may restrict your access to the Platform or its features, such as information required for registration.

Limit the communications you receive from us

You may choose what type of communication you would like to receive from us. However, some communications that are necessary for legal or security reasons, including changes to legal agreements, may not be limited.

You may reject or remove cookies through your browser settings. However, some services or products on the Platform may not function properly if cookies are disabled.

In general, all Learners have the rights specified in this section. Depending on where you are located, you may also have additional specific rights under the laws applicable in your jurisdiction.

If you are a Learner, you may exercise these rights through options available on the Platform upon login. If you face any issues or require clarification, you may write to us using the details in the Grievances section below.

Right to Confirmation and Access

You have the right to obtain confirmation and access to your Personal Information held by us, along with other supporting information.

Right to Correction

You have the right to request correction of inaccurate Personal Information and to update information that is incomplete or outdated.

Right to Nominate

You may nominate another person to act on your behalf in the event of your death or incapacity.

Right to Erasure

You have the right to request erasure of your Personal Information from our Platform. Please note that such erasure may result in permanent deletion of your account and may not be retrievable.

These rights apply only to your own information and not to that of other Learners. Where necessary, we may ask for additional information to verify your identity before fulfilling any request.

Protection of Your Information

We take all measures reasonably necessary to protect against unauthorized access, use, alteration, or destruction of Personal Information or other data on the Platform.

Disclosure of such information is limited to our employees, contractors, and affiliated organizations (if any) that:

  1. Need to know that information in order to process it on our behalf or provide services available on our Platform; and
  2. Have agreed not to disclose it to others.

We may also disclose information in response to a court order or other governmental request. Without limiting the foregoing, we reserve the right to disclose such information where we believe in good faith that such disclosure is necessary to:

  1. Comply with applicable laws, regulations, court orders, and government or law enforcement requests;
  2. Protect and defend a third party’s or our rights and property, or the safety of our users, employees, or others; or
  3. Prevent, detect, investigate, and take measures against criminal activity, fraud, misuse, or unauthorized use of our Platform.

To the extent permitted by law, we will attempt to provide you with prior notice before disclosing your information in response to such requests.

Third-Party Websites

You may find links to websites and services of our partners, suppliers, advertisers, sponsors, licensors, and other third parties. The content or links that appear on such sites are not controlled by us, and we are not responsible for the practices employed by these websites.

These websites may have their own terms of use and privacy policies. Browsing and interacting with any other website, including websites linked from our Platform, is subject to the terms and policies of those websites.

Cross-Border Data Transfer

Your information, including Personal Information, is stored, processed, and transferred to Amazon Web Services (AWS) servers and databases located in India. We may also store, process, and transfer information to servers in other countries depending on the location of our affiliates and service providers.

These countries may have different and potentially less stringent privacy laws. Personal Information may become subject to those laws and disclosure requirements as a result of governmental or regulatory inquiries, court orders, or similar legal processes.

If you use our Platform from outside India, including from the USA, EU, EEA, or UK, your information may be transferred to, stored in, and processed in India. By accessing our Platform or providing us with information, you consent to such transfer, storage, and processing.

Duration for Which Your Information Is Stored

We retain your information for as long as necessary for the purposes stated in this Policy, including compliance with legal obligations and business requirements.

Please note that we may not be able to delete all communications, comments, photos, files, or other material publicly made available by you on the Platform. However, we will anonymize your Personal Information so that you can no longer be identified as an individual in connection with such information.

We will never disclose aggregated or de-identified information in a manner that could identify you as an individual.

If you wish to exercise any of your rights to access, modify, or delete any or all information stored about you, you may do so using the options provided within the Platform or by writing to us at the email address provided in the Grievances section below.

Modification to Privacy Policy

We may modify, revise, or change this Policy from time to time. When we do so, we will revise the updated date at the beginning of this page. We encourage you to check the Platform frequently for any recent changes.

Unless stated otherwise, the current version of this Policy applies to all information that we have about you.

Country-Specific Additional Rights

Terms Applicable if You Are an Indian Resident

If you are located in India, you may have the following rights under applicable Indian data protection law, including the Digital Personal Data Protection Act and similar legislation where applicable:

  1. Right to Confirmation and Access: You have the right to obtain confirmation and access to your Personal Information along with supporting information.
  2. Right to Correction: You have the right to request correction or updating of inaccurate, incomplete, or outdated Personal Information.
  3. Right to Grievance Redressal: You have the right to register a grievance with us concerning the manner in which your Personal Information is being handled.

We collect and process Personal Information about you only where we have a legal basis to do so. The basis depends on the type of information collected and the context in which it is processed.

Terms Applicable if You Are a California State Resident

If you are a California resident, you may have the following rights to the extent and in the manner set out in the California Consumer Privacy Act (CCPA):

  1. The right to access the Personal Information that we hold about you;
  2. The right to know what Personal Information we intend to collect before the point of collection;

  4. The right to equal service without discrimination; and

  2. Characteristics of Personal Information described in the California Customer Records statute: Name, email address, username, unique identifier, and gender.
  3. Internet or other electronic network activity information: Browser and device data, usage patterns, cookies, IP address, domain server, and page visit data.
  4. Geolocation data: IP-based location information.
  5. Audio, electronic, visual, or similar information: Profile picture or other content uploaded to the Platform.
  6. Inferences: Inferences drawn from collected Personal Information, such as likelihood of retention or attrition.

CCPA Data Practices During the Last 12 Months

During the preceding 12 months, we may have collected the following categories of Personal Information:

  1. Identifiers;
  2. Characteristics of Personal Information described in the California Customer Records statute;
  3. Internet or other electronic network activity information;
  4. Geolocation data;
  5. Commercial information;
  6. Audio, electronic, visual, thermal, olfactory, or similar information; and
  7. Inferences.

We may have collected such Personal Information from you and our payment processors.

We may have used such information for the following business or commercial purposes:

  2. Provide our Services to you;
  3. Honor our Terms and Conditions and contracts;
  4. Ensure the privacy and security of our Platform and Services;

Personal Information sold: We have not sold categories of Personal Information during the preceding 12 months.

Personal Information disclosed for a business purpose: We may have disclosed the following categories of Personal Information during the preceding 12 months:

  1. Identifiers;
  2. Characteristics of Personal Information described in the California Customer Records statute;
  3. Internet or other electronic network activity information;
  4. Geolocation data;
  5. Commercial information;
  6. Audio, electronic, visual, thermal, olfactory, or similar information; and
  7. Inferences.

We may have disclosed such Personal Information to the following categories of third parties:

  1. Corporate parents, subsidiaries, and affiliates;
  2. Advisors such as accountants and attorneys;
  3. Service providers such as data analytics, data storage, mailing, marketing, technical support, and administration providers; and
  4. Operating systems and platforms.

Consumer Rights and Requests Under the CCPA

The CCPA gives consumers the right to request that we disclose what Personal Information we collect, use, disclose, and sell, and to request deletion of certain Personal Information collected or maintained by us.

Request to Know

California residents may request:

  1. The specific pieces of Personal Information we have collected about you;
  2. The categories of Personal Information collected about you;
  3. The categories of sources from which the information is collected;
  4. The categories of Personal Information sold and the categories of third parties to whom it was sold;
  5. The categories of Personal Information disclosed for a business purpose and the categories of third parties to whom it was disclosed;
  6. The business or commercial purpose for collecting, disclosing, or selling Personal Information; and
  7. The categories of third parties with whom we share Personal Information.

Our response will generally cover the 12-month period preceding receipt of a verifiable request.

Request to Delete

California residents have the right to request deletion of certain Personal Information collected or maintained by us, subject to applicable legal exceptions.

Submitting a Request

You may submit a request to know or delete by email using the address listed in the Grievances section or by any other method specified on the Platform.

Verification Process

We are required by law to verify the identity of any person submitting a request. To do so, we may require your name, email address, and mobile number (if already provided by you) and match them against records we already maintain.

If we cannot verify your identity to the required degree of certainty, we may deny the request or respond in a limited manner as required by law.

Authorized Agents

Authorized agents may submit requests on your behalf, subject to applicable verification and authorization requirements.

Excessive Requests

If requests are manifestly unfounded or excessive, particularly because of their repetitive character, we may either charge a reasonable fee or refuse to act on the request and notify you of the reason.

CCPA Non-Discrimination

You have the right not to receive discriminatory treatment for exercising your rights under the CCPA. We do not discriminate against users or consumers for exercising such rights.
